Can I bring weed to Texas?

2 min read · Last reviewed November 2026 · Independent guide

If you're coming from a state with legal weed, this is the question that matters most, so here's the honest version. What's normal at home stops being normal at the Texas line.

This one makes sense. You have a receipt, maybe a medical card, and you did everything right at home. Texas law doesn't look at any of that. Section 481.121 of the Health and Safety Code covers possessing a usable quantity of marijuana, wherever it came from. Up to 2 ounces is a Class B misdemeanor, more than 2 and up to 4 ounces is Class A, and more than 4 ounces is a felony.

Carts, wax and edibles made with concentrate deserve extra caution. Texas can treat those far more harshly than flower, even at small amounts, which catches a lot of people from legal states off guard.

What to do with your stuff

Leave it at home. Not in the glovebox, not in a checked bag, not in a friend's suitcase. The same goes for mailing it to your hotel, which is a bad idea on every level. If you have something in your bag right now and you're packing for Houston, take it out before you leave the house.

That's the whole plan, and it's a lot easier than it sounds. A Houston trip doesn't need it. You've got brisket, Rothko, a quarter million bats and more garlic butter than one person should see. Plan the good stuff with our Houston weekend itinerary.

The questions that come up

What if it's only a tiny amount?

Small amounts are still illegal. Harris County has a diversion program for some cases, but it's a prosecutor's policy with eligibility rules, it starts with being detained or arrested, and it doesn't reach every county around Houston. Don't plan a trip around it.

Didn't Houston just change something?

Houston voted on Prop A in November 2026. It's about what Houston police prioritize, and it doesn't make possession legal. Here's what Prop A means for visitors.

Can I bring it if I'm only passing through?

No. Texas law applies while you're in Texas, even on the way to somewhere else. Our guide to driving into Texas has more.

What about my medical card?

It doesn't count here. See does Texas accept out-of-state medical cards.

What you can bring home instead

Good stories, a Screw tape if you can find one, and a very full stomach. If you pick up a glass piece as a souvenir, read buying glass in Houston as a visitor and check the rules where you live.
